Judge Denies Elon Musk’s Request to Block OpenAI’s For-Profit Transition
A federal judge in San Francisco has ruled against Elon Musk’s request to halt OpenAI's plans to change from a nonprofit to a for-profit company. The judge described Musk's request as "extraordinary" but permitted him to pursue other aspects of a lawsuit he filed against OpenAI and its CEO, Sam Altman, last year.
Elon Musk was one of the founders of OpenAI, which started as a nonprofit in 2015 along with Sam Altman and other tech leaders. However, Musk departed from the organization in 2018 following a dispute regarding its direction. After his departure, Altman transitioned OpenAI to include a for-profit sector, allowing the company to raise significant funds needed for developing advanced artificial intelligence technologies.
Despite the transition, the nonprofit structure still maintained control over OpenAI. Recently, Altman began working on plans to transfer control from the nonprofit board to investors by converting OpenAI into a fully for-profit entity.
In response to these developments, Musk filed a lawsuit alleging that OpenAI and Altman breached the original agreements that prioritized public welfare by prioritizing commercial gains. Further expanding his claims, Musk accused OpenAI of violating antitrust laws by persuading investors not to invest in competing organizations, including Musk’s new AI venture, xAI.
OpenAI has responded positively to the court’s recent decision, with spokesperson Lindsey Held stating that Musk's intentions might benefit him personally but do not align with the broader mission of the organization. Musk had previously attempted to buy the nonprofit controlling OpenAI for over $97 billion, an offer that was ultimately rejected by the board.
